2011 Case Results and Wrap-Up

2011 was another successful year at Norton Hare, LLC. The firm was named in Kansas/Missouri SuperLawyers again and Lindsay Hare was named a Rising Star. Ryan Hare and Jay Norton were again named to the Top 100 Trial Lawyers by the National Trial Lawyers Association. Phil Stein joined the firm and began using his vast trial experience to represent his clients. The firm was busy all year with criminal defense, DUI and divorce cases. As we don’t have any more trials scheduled for the remainder of this year, it is time to release results obtained in some of our DUI cases for 2011. As usual it comes with the following disclaimer and caveat:

The following are some of the results we have obtained for clients in DUI cases in 2011. This list only includes DUI cases and not any of the results we have obtained in defending other types of cases. Also, this list only includes DUI cases that resulted in dismissals or acquittals and does not include the favorable results we have obtained for clients that involved resolution by plea or diversion. It is extremely important to remember, though, that past performance does not guarantee or predict future result. Every case is different and each must be judged on its own merits.
D.H. v. City of Olathe: Client stopped on a motorcycle for weaving and subjected to field sobriety tests. He was arrested and taken to the station where he blew a .110. Case dismissed by court prior to trial.
C.H. v. State of Kansas: Client stopped on New Year’s Eve for traffic infraction and charged with a felony DUI in Johnson County. Found Not guilty after a jury trial.
P.C. v. City of Lawrence: dismissed prior to trial.
R.L. v. City of Kansas City: Client involved in an accident and charged with a DUI. DUI charge reduced prior to trial.
C.B.: Client arrested for a felony DUI in Johnson County but case was not filed after Norton Hare, LLC’s involvement.
K.H. v. State of Kansas: Client stopped for Exhibition of Acceleration and charged with a felony DUI in Johnson County. Case dismissed by court prior to trial.
J.J. v. Kansas City: Client arrested for DUI after traffic stop for speeding. Case dismissed in Kansas City, Kansas prior to trial.
T.S. v. City of Mission: Client stopped in a DUI checklane in Mission, Kansas, and blew a .095. DUI dismissed prior to trial.
A.C. v. Overland Park: Client stopped for traffic infraction and arrested for DUI. He took a breath test and blew .112. Found “Not Guilty” after trial in Overland Park Municipal Court.
R.S. v. Mission Hills: Client stopped for traffic infraction and arrested for DUI. Case dismissed prior to trial.
E. B. v. City of Merriam: DUI dismissed prior to trial.
B.C.  v. Shawnee: DUI dismissed prior to trial in Shawnee Municipal Court.
P.S. v. State of Kansas: Client involved in a rollover accident and taken to hospital where his blood was drawn. Case dismissed by the Court in Johnson County, Kansas, prior to trial.
R.S. v. Kansas City: Client arrested for DUI. Breath test was .213. Case dismissed prior to trial.
H.W. v. Leawood: Found “Not Guilty” after trial in Leawood.
D.J. v. City of Olathe: Client arrested for DUI after a traffic infraction and field sobriety tests. He was taken to the station where he blew a .115. Olathe DUI charge was dismissed prior to trial.
J.K. v. City of Lawrence: Client involved in serious accident in Lawrence, Kansas and taken to the hospital. DUI charge dismissed prior to trial.
C.W. v. State of Kansas: Client stopped for traffic infraction in Gardner, Kansas, and charged with a DUI in Johnson County District Court. Breath test was .128. Found “Not Guilty” after trial.
S.B. v. Overland Park: Client stopped in parking lot of an apartment complex and given field sobriety tests. Arrested for DUI and taken to the police station where she blew .162 breath test. Overland Park DUI dismissed prior to trial.
T.B. v. Leawood: Client fell asleep in his car in parking lot. Given field sobriety tests and taken to the station where he blew a .155. Leawood DUI dismissed prior to trial.
K.C. v. State of Kansas: Client stopped for running a stop sign and given field sobriety tests. She blew a .145 and was charged with a felony DUI in Johnson County, Kansas. Felony DUI dismissed prior to trial.
D.S. v. Leawood: DUI dismissed prior to trial.
J.M. v. Overland Park: DUI dismissed prior to trial.
B.B. v. State of Kansas: Client contacted by Johnson County Sheriff’s Deputies because sleeping in his car on side of road. Arrested for DUI after field sobriety tests. DUI dismissed by Court prior to trial.
R.S. v. Shawnee: Client’s vehicle was stuck on railroad tracks and got hit by a train. Arrested for DUI after field sobriety tests and a breath test. DUI dismissed by prosecutor.
B. F. v. Leawood: DUI dismissed prior to trial.
T.K. v. Leawood: Client stopped for driving on a closed road and arrested for DUI. The breath test was a .175. Leawood DUI charge dismissed prior to trial.
A.C. v. Overland Park: Client involved in a serious accident and transported to the hospital where her blood was tested and found to be .240. DUI dismissed prior to trial.
J.S. v. City of Olathe: Client arrested after a car accident and transported to the hospital where his blood was tested and found to be .230. Olathe DUI dismissed prior to trial.
R.R. v. State of Kansas: Client arrested for a felony DUI in Wyandotte County, Kansas. Felony DUI dismissed prior to trial.
J.C. v. State of Kansas: Client involved in a rollover accident on I-35. He was given a breath test by at the Highway Patrol Troop headquarters which was a .126. Client found “Not Guilty” of DUI in Johnson County District Court after trial.
J. E. v. Gardner: Client stopped for traffic infractions and given field sobriety tests. Client was arrested for DUI and taken to the station where he was given breath and urine tests. DUI dismissed prior to trial.
