What Makes Olathe DUI Cases Different

Most people assume all DUI courts operate the same way.

They don’t.

1. Olathe Has Its Own Court Services Department

If your case results in diversion or probation, you will report directly to Olathe Court Services. They are generally full-time employees of the Olathe Municipal Court and all they do is monitor alcohol and drug related diversions and probations.

They control:

  • Your supervision
  • Your testing
  • Your compliance with diversion or probation

This is not passive oversight. It is structured and enforced and you will generally have to go in and meet with a court services officer once per month. If you get convicted of a DUI, Olathe Court Services will conduct a pre-sentence investigation (PSI) before you can be sentenced and that report will make recommendations to the judge about the conditions of probation.


2. The “Color Code” Testing System

If you are on diversion or probation, you will likely be placed on what we used to call the color code. Now it is called the “PIN Testing System” It is an intensive program of urine testing for drugs and alcohol.

That means:

  • You must call in or receive a text every single day for the entire year you are on diversion or probation (yes, every single day for 365 days)
  • If your PIN is called, you must drop a urine test the following day
  • Miss a test, fail a test or have an abnormal test = diversion/probation violation

Diversion in Olathe is not easy and it will require some effort.


3. Friday “Attorney Plea” Docket

Olathe runs a Friday morning attorney plea docket.

This is where:

  • Lawyers meet with prosecutors
  • Cases are negotiated
  • Strategy matters

In most cases, you do not have to appear unless your case is being resolved. Your attorney can appear for you.

Sometimes if you refuse a test the officer will get a search warrant for your blood and then you are forced to give a blood test. That blood sample in an Olathe DUI case will be sent to the Johnson County Sheriff’s Department Crime Lab and it will take a month or two to get the result back.
