2014 DUI Case Results
The following are some of the results we have obtained for clients in DUI cases in 2014. This list only includes DUI cases and not any of the results we have obtained in defending other types of cases. Also, this list only includes DUI cases that resulted in dismissals or acquittals and does not include the favorable results we have obtained for clients that involved resolution by plea or diversion. It is extremely important to remember, though, that past performance does not guarantee or predict future result. Every case is different and each must be judged on its own merits. No expectation of similar results in other cases should be implied by this information.
State of Kansas v. B.L.: Client was charged with a felony DUI in Johnson County District Court after a car accident and a positive urine test. After several years of litigation the felony DUI was dismissed on the day of jury trial.
City of Gardner v. J.P.: Client stopped for traffic infractions in Gardner, Kansas and failed a breath test with a .234 result. DUI dismissed prior to trial.
City of Lenexa v. J.P.: Client arrested for DUI after a weaving out of his lane and field sobriety tests. Found “Not Guilty” in Lenexa Municipal Court.
City of Mission Hills v. J.B.: Client charged with DUI in Mission Hills Municipal Court after bowing .232 on breath test machine. Case dismissed after the filing of motions.
City of Spring Hill v. T.H.: DUI dismissed in Spring Hill Municipal Court due to an illegal detention.
State of Kansas v. J.G.: Client was charged in Johnson County District Court with a felony DUI after positive breath and urine tests. The felony DUI was later dropped to a misdemeanor and then dismissed altogether prior to trial.
City of Overland Park v. J.D.: DUI dismissed by the court after the filing of motions.
State of Kansas v. J.S.: Client was stopped for traffic infraction and arrested after field sobriety tests. A breath test resulted in a .150 BAC. DUI dismissed after filing of motions.
City of Overland Park v. S.K.: Client was arrested for DUI after a car wreck in Overland Park. Found “Not Guilty” after trial.
City of Linn Valley v. P.G.: Client arrested after car accident. Failed sobriety tests and failed a breath test at .114. DUI dismissed by prosecutor.
State of Kansas v. D.M.: Client arrested and charged in Anderson County District Court after field sobriety tests and a breath test of .159. Case dismissed after filing a motion to suppress for an illegal seizure.
City of Mission Hills v. R.P.C.: Client stopped for weaving out of the marked lanes of the road and arrested for DUI after field sobriety tests. Case dismissed in Mission Hills Municipal Court.
City of Overland Park v. G.C.: DUI dismissed by prosecutor in Overland Park Municipal Court.
State of Kansas v. R.H.: DUI dismissed by prosecutor in Johnson County District Court.
City of Kansas City, KS v. W.M.: Client contacted while asleep in car at a stoplight. Arrested after field sobriety tests. DUI dismissed by prosecutor after the filing of motions.
City of Lansing v. B. B.: Client contacted sleeping in his car in restaurant parking lot after hours. Arrested for DUI after field tests. DUI dismissed prior to trial.
City of Kansas City, Kansas v. B.E.: DUI dismissed prior to trial.
