Facebook Post Earns Teen An Arrest

An Oregon teenager went on Facebook shortly after a New Year’s Eve episode of self-described drunk driving and bragged about his hitting a couple of cars getting home. The police were made aware of the post and, with the clear confession by the driver, went to his house and placed him under arrest for leaving the scene of an accident. The story is here. I have blogged a few times about the danger of social media and the DUI case. The story underscores a couple of suggestions about what not to do after a Kansas DUI arrest: There is certainly nothing to brag about. I suggest that you not tell anyone about the incident other than your most trusted advisors. Just the rumor of an arrest can cause problems at work, school or elsewhere. Also, facebook photos of you drinking or discussing how much you can or have drank is not likely to be helpful. In this day and age, people like to post pictures and videos of themselves at parties, in bars and out on the town and/or their friends tag them in such photos. That can be evidence that can be used to make a case against you to show where you were and what you were doing on the night in question. Photos of you drinking or status updates from drinking establishments after the arrest could be used to show that you did not take the arrest seriously and that you continued to party while the case was pending, perhaps in violation of bond conditions. Of course, a person that gets placed on DUI diversion or probation in Kansas will be prohibited from drinking so photos of you violating diversion or probation are not good. So, this story demonstrates again that it is wise to be careful with facebook or other social media sites.
